Terms of Service

1. Acceptance

By accessing or using AuraDaq ("the Platform", "we", "us"), you agree to be bound by these Terms of Service and all applicable laws. If you do not agree, do not use the Platform. The binding version of these Terms is the version in effect — and shown to you — at the time you create an account or join the waitlist; your acceptance is recorded with a version stamp. Continued or repeated use of the Platform after changes take effect constitutes acceptance of the updated Terms.

2. Nature of the Platform — Satire & Opinion

AuraDaq is a work of satire and social commentary. All "aura scores" and rankings are fictional, subjective metrics created for entertainment, parody, and commentary purposes only. They are statements of opinion and protected expression — not statements of fact, and not factual assessments of any person's character, worth, reputation, conduct, or creditworthiness. No reasonable reader should interpret an aura score as a literal or factual claim.

AuraDaq is independent. We are not affiliated with, endorsed by, sponsored by, or authorised by any individual, brand, or organisation featured on the Platform. Any names, trademarks, or likenesses are used nominatively for commentary, criticism, and identification.

All events submitted to the Platform must include a source link to a credible news outlet or public record. Events are reviewed by administrators before publication.

3. Eligibility

  • You must be at least 18 years old to create an account, join the waitlist, or otherwise use the Platform.
  • You must provide accurate information during registration.
  • You are responsible for maintaining the confidentiality of your account and for all activity under it.

4. User Submissions

By submitting an event, you represent and warrant that:

  • The described event is factual and accurately sourced from the linked URL.
  • The subject is a public figure acting in their public capacity.
  • Your commentary does not constitute defamation, harassment, incitement, or any unlawful content.
  • You have all rights necessary to submit the content and grant the licence below.
  • You grant AuraDaq a worldwide, non-exclusive, royalty-free licence to host, display, reproduce, and distribute your submission on and in connection with the Platform.

AuraDaq reserves the right to remove, edit, or refuse any submission that violates these Terms or our Community Guidelines, without prior notice.

5. Prohibited Conduct

  • Submitting false, fabricated, or misleading events.
  • Targeting, identifying, or commenting on private individuals (non-public figures).
  • Harassment, hate speech, threats, or content that targets a protected characteristic.
  • Posting another person's private or personal information (doxxing).
  • Automated scraping, spamming, or vote manipulation.
  • Circumventing rate limits, access controls, or security measures.
  • Any use that is unlawful in your jurisdiction or ours.

6. Intellectual Property & Third-Party Names

The AuraDaq name, logo, and system design are owned by AuraDaq. User submissions remain the intellectual property of their authors, subject to the licence granted in Section 4.

All third-party names, trademarks, service marks, and likenesses referenced on the Platform are the property of their respective owners and are used solely for the purpose of identification, commentary, and parody. Their use does not imply any endorsement, affiliation, or sponsorship.

7. Disclaimers & Limitation of Liability

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Aura scores are satirical and non-factual.

To the maximum extent permitted by applicable law, AuraDaq is not liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from use of the Platform or reliance on its content, and AuraDaq's total aggregate liability for any claim will not exceed one hundred US dollars (US$100).

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law. This includes, where the law so provides, liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, and any non-excludable rights or guarantees you have as a consumer — for example under EU/UK consumer law, the Australian Consumer Law, India's Consumer Protection Act, 2019, or comparable legislation. Where such law applies, the limitations and exclusions above apply only to the extent that law permits.

8. User Content & Intermediary Safe Harbor

AuraDaq is an intermediary and interactive computer service. Event submissions, comments, and votes are user-generated content provided by third parties. We host and display such content but are not its author or originator. We rely on the protections available to intermediaries and hosting providers under applicable law, including: Section 230 of the U.S. Communications Decency Act (47 U.S.C. § 230); the hosting safe-harbour provisions of the EU Digital Services Act (Regulation (EU) 2022/2065); the operator-of-a-website defence under section 5 of the UK Defamation Act 2013; and the intermediary safe harbour under section 79 of India's Information Technology Act, 2000 read with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

AuraDaq retains the right, but not the obligation, to moderate, edit, or remove any user submission at its sole discretion without thereby becoming the author or publisher of the content.

9. Notice-and-Takedown & Grievance Redressal

If you believe content on the Platform is unlawful, infringing, defamatory, or otherwise violates these Terms, you may submit a notice to our Grievance Officer. We acknowledge complaints within 48 hours and aim to resolve them within 15 days, consistent with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

AuraDaq is an independent project operated by its founder as a sole proprietor in India, who also acts as Grievance Officer. Reach the Grievance Officer at legal@auradaq.com; a postal address is available on request.

10. Indemnification

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless AuraDaq, its operators, and affiliates from and against any claim, demand, loss, liability, damage, or expense (including reasonable attorneys' fees) arising out of or related to (a) your submissions, votes, or other content posted on the Platform, (b) your violation of these Terms or the Community Guidelines, (c) your violation of any law or third-party right, or (d) your use of the Platform.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of India, without regard to its conflict-of-law principles. Subject to the paragraph below, any dispute arising out of or related to these Terms or use of the Platform shall be resolved exclusively in the courts located in Delhi, India, and you consent to the personal jurisdiction of those courts.

If you are a consumer resident in the European Union, the United Kingdom, or another jurisdiction whose law guarantees you the protection of mandatory local provisions or access to your local courts, nothing in these Terms deprives you of that protection or that right, and you may bring proceedings in your country of residence.

To the maximum extent permitted by applicable law, you agree that any claim will be brought in your individual capacity and not as a plaintiff or class member in any class or representative action, and that any claim must be filed within one (1) year after the cause of action arises or be permanently barred. These limitations do not apply where the applicable law does not permit them.

12. Termination

AuraDaq may suspend or terminate accounts that violate these Terms at any time, with or without notice. You may delete your account at any time by contacting legal@auradaq.com.

13. Changes to Terms

We may update these Terms from time to time. We will update the "last updated" date and, for material changes, take reasonable steps to notify you. Continued use of the Platform after changes take effect constitutes acceptance of the new Terms.

14. Severability

If any provision of these Terms is held unenforceable, that provision will be limited or severed to the minimum extent necessary, and the remaining provisions remain in full force and effect.

15. Entire Agreement, Waiver & Assignment

These Terms, together with the Privacy Policy and Community Guidelines, are the entire agreement between you and AuraDaq regarding the Platform. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
